Decisions relating to Development Applications
In assessing Development Applications that are exhibited, we will take into account any valid submissions received. Submissions will be considered on the basis of merit and relevance, with details of this consideration outlined within the assessment report.
Where the number of valid submissions in objection to the development received in response to a notified development application is 10 or more, the assessment report and a recommendation will be referred to a meeting of the Council for determination. Otherwise, the Development Application will be determined by staff under delegated authority. Note - The Wagga Wagga DCP 2010 may contain other circumstances whereby an application must be referred to Council for determination.
Where an application is to be referred to a meeting of the Council for determination, we will notify all individuals and entities that have made a valid written submission. Objectors, applicants, or any other interested persons are welcome to attend the Council meetings and may apply to address the Councillors and Senior Staff during the meeting. Southern Region Planning Panel - Where the development is declared as regionally significant development under state planning policy, the Development Application will be determined by the Southern Region Planning Panel, irrespective of the number and type of submissions received.
Notification of Decision
Once a development application has been determined, we will notify the decision in the following ways:
- All individuals and entities that have made a valid written submission in accordance with the provisions of this plan will be notified in writing to the return postal address or email provided.
- The following information will be provided via our on-line development application tracking service, consistent with the mandatory requirements of Schedule 1 of the Environmental Planning and Assessment Act 1979:
- The decision
- The date of the decision
- The reasons for the decision
- How the community views were taken into account in making the decision
The decision and the date of the decision will be provided within the published Notice of Determination. The reasons for the decision and consideration of community views will be contained within the published Assessment Report.
Development Applications withdrawn - Where a Development Application has been notified and is then withdrawn by the applicant prior to being determined, all individuals and entities that made a written submission will be notified of the withdrawal in writing.
Petitions – We will provide written notification of the decision (or any withdrawal) to the person identified as the primary contact on the petition. Alternatively, the written notification will be sent to the first individual listed in the petition having legible contact information. Other individuals identified on the petition will not receive notification.
