Activities that require approval

PART A1 - Install a manufactured home, movable dwelling or associated structure on land

PART B4 - Carry out sewerage work

PART B5 - Carry out stormwater drainage work

PART B6 - Connect a private drain or sewer with a public drain or sewer under the control of a Council or with a drain or sewer which connects with such a public drain or sewer.

PART F2 - Operate a caravan park or camping ground.

PART F3 - Operate a manufactured home estate.

PART F4 - Install a domestic oil or solid fuel heating appliance, other than a portable appliance.

Applying for Approval

An approval for an activity under Section 68 of the Local Government Act 1993 can be sought from Council under two separate assessment processes.

These two processes are either as a stand alone application for the activity, or in conjunction with a Development Application which is seeking approval under the Environmental Planning and Assessment Act 1979 for a use to which the activity is related.

The procedure for both processes is summarised below.

Stand Alone Application:

1. Applicant completes Section 68 Application Form
2. Applicant complete "Attachment A" form
3. Applicant lodges Application Form and "Attachment A" form with Council
4. Council assesses application under Section 68 of the Local Government Act 1993
5. Council determines application and issues a "Notice of Activity Application Determination" under the provisions of the Local Government Act 1993

Application made in conjunction with the Development Application:

1. Applicant completes Development Application form
2. Applicant ticks Section 68 box on Development Application form
3. Applicant completes "Attachment A" form
4. Applicant lodges Application Form and "Attachment A" form with Council
5. Council assesses application under the Environmental Planning and Assessment (EP&A) Act 1979 (including the provisions of the Local Government Act 1993 called up under 78A(3) of the EP&A Act)
6. Council determines application under the provisions of the EP&A Act and issues a "Notice of Determination" under EP&A Act (including any conditions of any S.68 Activities Approval)

For a stand alone application, a Section 68 Application form and an Attachment A form need to be completed and submitted to Council, along with the relevant application fees.

For a Section 68 application made in conjunction with a Development Application, a Development Application form and Attachment A form need to be completed and submitted to Council, along with any other documentation required by the DA and the applicable application fees.

Section 68 Amusement Devices

Operators of amusement devices are required to make application to Council for approval to operate their amusement devices anywhere in the City unless the amusement device is not required to be registered under the Occupational Health and Safety Regulation 2001 or if the amusement device meets the exemption requirements of clause 75 of the Local Government (General) Regulation 2005.

The power to enforce this requirement is obtained through Section 68 (Part F, 5) of the Local Government Act 1993 and Subdivision 5 of the Local Government (General Regulation) 2005.

When an event is being held in the Wagga Wagga City Council Local Government Area that has affected devices, delegates from Council will attend and facilitate the applications and undertake required inspections on-site.
